BS Energy Services Ltd
These Terms & Conditions apply to services supplied by BS Energy Services Ltd in New Zealand. By accepting our quotation, booking our services, approving work, or allowing us to commence work, you agree to these Terms & Conditions.
BS Energy Services Ltd provides services including electrical work, heat pump and air conditioning installation, servicing and repairs, ventilation, refrigeration, fault finding, maintenance and related services.
Quotations are based on the information available to us at the time of quoting. Unless stated otherwise, a quotation covers only the work specifically described in the quotation.
Additional work, materials, faults, access difficulties, building conditions or other issues discovered after work begins may result in additional charges. Where reasonably practical, we will discuss significant additional work with the customer before proceeding.
Prices are in New Zealand dollars. GST will be applied where applicable and as stated on the quotation or invoice.
Any additional work requested by the customer that is outside the accepted quotation may be charged separately for labour, materials, travel and other applicable costs.
A deposit may be required before equipment is ordered or work is scheduled. The required deposit, if applicable, will be shown on the quotation or otherwise advised to the customer.
The remaining balance is payable in accordance with the payment terms stated on the invoice or quotation.
BS Energy Services Ltd reserves the right to postpone work, equipment ordering or installation until any required deposit has been received.
If you need to cancel or reschedule an appointment, please contact us as early as possible.
Where equipment, materials, subcontractors or other costs have already been committed specifically for your job, the customer may be responsible for reasonable costs already incurred, subject to applicable New Zealand law.
The customer must provide reasonable and safe access to the property and the areas where work is required.
The customer should advise us before work begins of any known hazards, restricted areas, concealed services, asbestos or other circumstances that may affect the safe completion of the work.
All regulated work will be carried out in accordance with applicable New Zealand requirements and by appropriately authorised persons where required.
Where existing electrical systems, wiring, pipework, drainage, structures or equipment are found to be unsafe, defective or unsuitable, additional remedial work may be required before installation or repair can be completed.
Fault finding is undertaken using reasonable professional care and the information and symptoms available at the time.
Some faults may be intermittent or may involve multiple components. Replacing or repairing one faulty component does not guarantee that another unrelated or previously undetectable fault will not subsequently occur.
Diagnostic, call-out, labour, travel and parts charges may apply as advised at the time of booking or quotation.
Equipment selection and sizing may be based on site conditions, measurements, customer requirements and information available at the time of assessment.
Performance can be affected by factors including insulation, glazing, ceiling height, building construction, outdoor temperature, room usage, doors and windows, equipment maintenance and other environmental conditions.
Where BS Energy Services Ltd agrees to install equipment or materials supplied by the customer, we are not responsible for defects, incorrect specifications, missing components or manufacturer warranty issues relating to customer-supplied products.
Our responsibility in such cases is limited to the work we perform, subject to applicable New Zealand law.
Equipment supplied by us may be covered by the relevant manufacturer's warranty. Manufacturer warranty conditions, exclusions and claim procedures apply.
BS Energy Services Ltd does not control manufacturer warranty decisions, but we may assist customers with warranty matters where appropriate.
BS Energy Services Ltd stands behind its workmanship. Any workmanship warranty offered by us is subject to the conditions stated in the quotation, invoice or warranty documentation.
Please contact us promptly if you believe there is a problem with work completed by us so that we have a reasonable opportunity to inspect and, where appropriate, remedy the issue.
We are not responsible for pre-existing defects or conditions that could not reasonably have been identified before work commenced.
This may include concealed wiring, pipework, drainage, structural problems, water damage, asbestos, inaccessible services or other hidden conditions.
We will take reasonable care while working at your property. Some installation and repair work may require drilling, cutting, access openings, removal of existing equipment or other reasonable alterations necessary to complete the work.
Any special requirements regarding finishes, access or protection of particular areas should be discussed with us before work begins.
We will make reasonable efforts to complete work within the expected timeframe. However, timing may be affected by equipment availability, supplier delays, weather, access, unexpected site conditions, subcontractor availability or circumstances outside our reasonable control.
The customer is responsible for providing accurate information relevant to the work, obtaining any permissions or approvals for which the customer is responsible, providing safe access and following operating and maintenance instructions supplied for installed equipment.
Personal information collected by BS Energy Services Ltd is handled in accordance with our Privacy Policy and applicable New Zealand privacy law.
Nothing in these Terms & Conditions is intended to exclude, restrict or modify any rights or remedies that cannot lawfully be excluded under New Zealand law, including rights that may apply under the Consumer Guarantees Act 1993 and Fair Trading Act 1986.
BS Energy Services Ltd may update these Terms & Conditions from time to time. The version applicable to a particular job will generally be the version in effect when the relevant quotation or service is accepted, unless otherwise agreed or required by law.
